RISK EXCLUSIONS

Blood and/or blood plasma, bullion and money of every description (e.g. cash, bank notes, coins, currency notes), livestock, bloodstock and living creatures, loose precious stones, any cargo while being transported under its own power or while being towed on its own axle (e.g. motor vehicles, motor cycles, caravans, horse boxes, trailered boats), any interest owned, hired by, leased or loaned to DHL Transport Brokerage

In no case shall DHL Transport Brokerage be liable for loss or damage to cargo or expenses arising therefrom caused by:

1. willful misconduct of the shipper
2. ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear;
3. insufficiency or unsuitability of packing or preparation of the cargo to withstand the ordinary incidents of the transit where such packing or preparation is carried out by the shipper or their employees or prior to the pick-up of the shipment (for the purpose of these terms, "packing" shall be deemed to include stowage in a container and "employees" shall include independent contractors);
4. inherent vice or nature of the cargo;
5. delay;
6. insolvency or financial default of the owners, managers, charterers or operators of the vehicle where, at the time of loading of the cargo on board the vehicle, the shipper are aware, or in the ordinary course of business should be aware, that such insolvency or financial default could prevent the normal prosecution of the voyage. This exclusion shall not apply where the party claiming hereunder has bought or agreed to buy the cargo in good faith under a binding contract;
7. or arising from the use of any weapon or device employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter, whether directly or indirectly;
8. unworthiness of vehicle or craft or unfitness of vehicle or craft for the safe carriage of the cargo, where the shipper are aware of such unworthiness or unfitness, at the time the cargo is loaded therein;
9. unfitness of container or conveyance for the safe carriage of the cargo, where loading therein or thereon is carried out prior to the pick-up of the cargo or by the shipper or their employees and they are aware of such unfitness at the time of loading;
10. Exclusion 8 & 9 above shall not apply where the party claiming hereunder has bought or agreed to buy the cargo in good faith under a binding contract;
11. War, civil war, revolution, rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power;
12. derelict mines, torpedoes, bombs or other derelict weapons of war;
13. strikers, locked-out workmen, or persons taking part in labor disturbances, riots or civil commotions;
14. or resulting from strikes, lock-outs, labor disturbances, riots or civil commotions;
15. any act of terrorism, being an act of any person acting on behalf of, or in connection with, any organization which carries out activities directed towards the overthrowing or influencing, by force or violence, of any government whether or not legally constituted;
16. any person acting from a political, ideological or religious motive.
